The organization at Asheboro stems from a neutrality agreement included in the 2003 USWA / Goodyear master contract. Since the deal went into effect, the USWA has organized the workers at several non-tire company plants, including Asheboro. An arbitrator confirmed in March that a majority of the 350 hourly workers there signed USWA authorization cards.
However, a group of workers alleged that when they tried in writing to revoke signing the cards, something they have the right to do, the company, union and arbitrator all ignored the revocations, said Stefan Gleason, NRTW Foundation vice president.
Some of the workers also have claimed they were coerced into signing the cards, Gleason claims. They said they were told the card represented a vote for an election or to ensure good health care, he said, and in some cases, the workers signed cards just to "get someone off their back."
The unfair labor practice charges ask the NLRB to recount the cards and recognize the revocation letters sent by the workers. The decertification petition was signed by more than 30 percent of the Asheboro hourly workers, Gleason said, and should allow for a secret-ballot election to determine if the majority of the employees want to decertify the union.
The USWA hasn't been charged with coercing employees to get them to join the union or other misconduct, only that there hadn't been a majority attained when the union demanded recognition, a spokesman for the union said. The neutrality agreement is legal and is designed to protect workers from intimidation, he said, and.
